Taxes for property buyers

Skip the old two percent line on the buyer's side. Buyers in Albania do not pay a 2% transfer tax. The seller typically pays 15% capital gains tax on the gain under Law 29/2023, the buyer's cash at closing is mostly notary, ASHK, and legal fees, often about 4-7% of the price, and the annual residential building tax after registration is 0.05% of the fiscal reference value.

We still hear the 2% figure on first calls, usually borrowed from another country's comparison. It does not belong on this deed.

Where tax shows up

Tax shows up at the seller's exit, in the buyer's closing file as fees rather than as a transfer tax, every year while you hold the apartment, and again if you rent it out. VAT on some new builds, and a temporary revaluation window, sit nearby and have their own pages. The three charges that actually sit on a typical buyer are the seller's 15% on the gain, the annual 0.05% building tax, and 15% on rental income if you let.

Who may own the place is a purchase question. Foreign individuals can hold apartments and buildings in their own name. Agricultural land, forest, and pasture cannot be bought directly by a foreign individual. The steps are in buying property in Albania. The notes below assume a registrable residential unit in your own name, the common European case in Tirana, Vlore, Sarande, and Durres.

AlbaniaHouse is a matching platform. It introduces buyers to local sales offices and specialists. It is not a seller, notary, or lawyer, and nothing here is a tax opinion on your file. The taxes section is a map. Your adviser still signs the return.

Which of these four is actually yours?

No two percent transfer tax

A 2% figure still circulates from other countries. A normal apartment sale is not charged that way. You pay a notary tariff of roughly 0.23-0.35% of value, ASHK registration of about 3,500 ALL, a notary filing of about 4,000 ALL, then legal fees, translations, and apostilles, often landing around 4-7% together. Itemise that in the cost of buying. Do not add another 2% on top.

Refuse the extra line.

The fixed lek amounts matter more on a modest price. On a large price the notary's ad valorem tariff and the lawyer's fee dominate. Ask for the tariff before you reserve, and convert lek with that day's Bank of Albania rate, not a rate from a sales PDF.

Ask first.

The seller's fifteen percent

Law 29/2023 is Albania's income-tax law. Under it the seller typically bears 15% capital gains tax on the gain, not on the whole sale price. The gain is the difference your adviser computes between the disposal and the base the law allows, using the acquisition documents and the rules in force. It is not a flat slice of the headline, and it is not a charge the buyer adds "just in case."

Keep the papers that define the base: the notarial deed, proof of what you paid, invoices for capital improvements that counsel agrees can be included, and the ASHK extract. A lost purchase file turns a later sale into an argument about the base. That argument costs more than a labelled folder.

Check the extract.

Reference prices are not the gain. Consul 2026 is a fiscal schedule: Vlore centre and the Lungomare about 140,000 ALL per square metre, roughly EUR 1,452, Durres marina up by as much as 196%, Himare zone 1 up 141%, Sarande main coast up 53%.

A higher reference value can change assessments that use it, including the annual building tax. It does not mean the seller's taxable gain is 196%, or 141%, or 53%. A gain needs a disposal and a computed difference.

Asking prices are a third series. Vatreja Q3 2026 listings sit near EUR 2,084 per square metre in Vlore, EUR 2,017 in Sarande, EUR 1,900 in Tirana, and EUR 3,410 in Dhermi. Listings are not sale prices and not the tax base.

If you buy from a private seller, ask whether the seller's tax is withheld or paid through the notary, and whether your contract price is the figure used. A seller who wants you to gross up their tax is negotiating. That is not a statutory transfer tax. Write it down, or refuse it.

Write it down.

The yearly building tax

Once the apartment is yours, the annual residential building tax is 0.05% of the fiscal reference value, often collected with the water bill. That is easy to miss if you are abroad and the bill goes to a neighbour or a manager. After ASHK registration, confirm the municipality has you as the person who pays, and keep the receipts with the deed.

The rate is simple. The base is the fiscal reference value, not the price you wish you had paid and not the Vatreja asking level. Consul 2026 puts Vlore centre and the Lungomare at about 140,000 ALL per square metre. At 0.05% that is 70 ALL per square metre per year.

On an illustration of 60 square metres at that reference level, the annual tax would be 4,200 ALL. Your parcel can differ with zone, use, and the schedule, so treat 4,200 ALL as an order of magnitude, not as your bill.

Look at the water bill.

A Durres marina reference value up by as much as 196%, or a Sarande coast value up 53%, raises this lek bill even though the 0.05% rate did not change. Owners who budgeted a quiet year and then ignored the 2026 schedule will see the water-bill line move. Convert the lek bill with the Bank of Albania reference rate when you report costs in euro. Do not pick the rate that makes the holding cost look smallest.

The building tax is not the administrator's fee, the lift reserve, or insurance. Those are contracts. On many coastal blocks they exceed 0.05% of the reference value. Put them beside the tax. Do not call them tax when you compare Albania with a council tax at home.

Rent taxed at fifteen percent

If you let, Law 29/2023 is why the rent is not free of tax merely because the guest paid from abroad. Individuals commonly pay 15% on rental income. From 2026, an individual with no other commercial activity need not open a NIPT just to let. The income is declared through DIVA by 31 March, and the 15% is paid on the rental income. Download the platform statement while you can still log in. DIVA is a declaration channel, not a suggestion.

File by 31 March.

VAT is separate from that 15%. A 6% VAT rate needs a Ministry of Tourism accommodation certificate on the property. Without the certificate, the VAT rate in point is 20%. Do not assume a brochure that mentions 6% has checked your unit. The certificate, what it attaches to, and how a new-build price treats VAT are in VAT on new-build property. Do not fold VAT into the 15% and call the result one tax.

Foreign guests are registered within 24 hours, usually by the manager. Put that in the management contract. A missed registration is a bad surprise in August.

A long let in Tirana and a seasonal let in Vlore or Sarande share the 15% idea and not the cash pattern. The tax follows income you receive. Empty months still leave the building tax, the administrator, and utilities. Yield maths that forgets the 15% is on the investing page. The rate belongs here.

Where VAT sits

New-build contracts sometimes include VAT and sometimes do not. The standard rate, where it applies, is 20%. The 6% accommodation case depends on the tourism certificate. Read VAT on new-build property before you compare two developers. A lower headline that excludes VAT is not a lower price. Do not add the 15% rental tax, the 0.05% building tax, and VAT into one levy.

Read the contract.

The 2026 revaluation window

Law 85/2025 opens a window to revalue property until 31 December 2026, with tax at 5% on the uplift instead of 15%. For someone who already holds, the point is to reset the fiscal base by paying 5% on the step-up, rather than leaving a larger difference to be dealt with later at 15%. You choose whether to use the window. It is not a discount on the purchase you are about to make, and it is not the seller's ordinary 15% rolled into your closing costs.

The deadline is 31 December 2026. Anyone who already owns should have an Albanian adviser run the uplift on the real fiscal values, including Consul 2026 levels where those apply. A buyer who has not completed does not save ten points by rushing a deed in order to revalue the same week.

Mark the date.

Three sources people mix up

Sales conversations blur three public sources. Keep them in separate columns.

  • Consul 2026 reference prices. Fiscal value per zone, in ALL per square metre. Use them for the building tax at 0.05% and for revaluation. The jumps are up to 196% in the Durres marina zone, 141% in Himare zone 1, and 53% on the Sarande main coast.
  • Vatreja Q3 2026. Asking prices, not completed sales: about EUR 3,410 per square metre in Dhermi, EUR 2,084 in Vlore, EUR 2,017 in Sarande, and EUR 1,900 in Tirana. Useful for judging a brochure. They do not enter the 0.05% sum.
  • Law 29/2023. Income tax, including 15% on a gain and 15% on rental income. Seller's exit, and landlord filings via DIVA.
  • Law 85/2025. 5% on an uplift until 31 December 2026. A holder's choice, not a buyer transfer tax.
  • Bank of Albania. Official lek reference rates, for converting a lek bill or a fiscal value into euro.
  • INSTAT. National construction and tourism statistics. Context, not a unit's tax base, and not a capital gain.

The Bank of Albania rate is how you translate lek and euro on a given day. It is not a fourth property price.

Name the source.

Owning is not tax residence

Registering an apartment at ASHK does not make you an Albanian tax resident, and it does not grant a residence permit. Day count, where your life is centred, and the permit you hold are separate tests. Law 79/2021 is the immigration statute. It includes routes that can relate to property you own, and it does not include a golden visa. The move is set out in relocating to Albania. Do not buy a flat and assume the flat will choose your tax outcome.

There is no golden visa.

Home-country reporting still applies. A Dutch or German tax resident who owns in Tirana or on the coast generally has to tell the home authority about the property and the income, under that country's rules and any treaty. Paying 15% in Albania does not, by itself, close the home return. Take the assessments and the DIVA filing to the adviser who signs the return where you live. Residency covers the stay. It does not file the tax.

Keep the rates apart

In Vlore the Consul 2026 centre and Lungomare level is about 140,000 ALL per square metre, roughly EUR 1,452, and the Vatreja Q3 2026 asking level is about EUR 2,084. The building tax uses 0.05% of the fiscal value, not of the asking price. The seller's 15% is on the gain. The buyer's 4-7% is fees. VAT is a separate contract question.

Separate them.

Tirana's asking level is about EUR 1,900 per square metre, Sarande about EUR 2,017, Dhermi near EUR 3,410. None of those is the lek base on the water bill. If a manager quotes the charge in euro, ask which Bank of Albania rate was used and ask for the assessment in lek.

Buyers who lift the price to cover the seller's 15% raise the purchase price and the notary tariff of roughly 0.23-0.35% of value. That is not a second transfer tax. The ASHK fee, about 3,500 ALL, and the notary filing, about 4,000 ALL, stay small. Put each line on the completion statement.

A manager can register foreign guests within 24 hours. The manager does not file your DIVA return by 31 March, or get a tourism certificate you lack, unless the contract says so and the law allows it. Without the certificate, 6% VAT talk is 20% talk. Pay the 15% on the rent either way.

Holders looking at Law 85/2025 should compare 5% of the uplift with the 15% later. The window ends 31 December 2026. A buyer who has not completed is not in that comparison yet.

Call your adviser.

A calendar you can use

Before the deed, get the tariff and refuse a 2% transfer line. At the deed, confirm who pays the seller's 15% and keep the price evidence. After ASHK, make sure the 0.05% building tax reaches you. If you let, register guests within 24 hours and file DIVA by 31 March. If you already hold, ask about Law 85/2025 before 31 December 2026. Each year, convert lek at the Bank of Albania rate you used, and keep the PDF.

Keep the receipts.

Wrapping up

If a 2% line is still sitting on a draft completion statement, bring it to a call on the appointment page. Our introductions stop at a local specialist. They do not replace the adviser who computes the gain. The cost of buying is where the 4-7% range becomes numbers for your own deed.
